Denso Wave owns a number of patents on QR code technology, but has chosen to exercise them in a limited fashion. In order to promote widespread usage of the technology Denso Wave chose to waive its rights to a key patent in its possession for standardized codes only.

The licensing and trademark status of QR codes involve several key points:

Patent Status:

Denso Wave, the creator of QR codes, holds patents related to QR code technology. The US patent (US 5726435) and the Japanese patent (JP 2938338) have both expired. The European patent (EP 0672994) also expired in March 2015. Denso Wave has chosen not to enforce its patents for standardized QR codes, promoting widespread use of the technology.

Trademark Status:

The term 'QR Code' itself is a registered trademark and wordmark of Denso Wave Incorporated. In various jurisdictions, including the UK (registered as E921775), US (Trademark 2435991), and European Union (OHIM registration), Denso Wave holds trademarks for the term 'QR Code.' These registrations protect the use of the term specifically as it relates to Denso Wave's branding of QR codes.

Licensing and Use:

QR code technology is freely licensed as long as users adhere to the standards documented by JIS (Japanese Industrial Standards) or ISO/IEC. Standardized QR codes do not require special licensing from Denso Wave due to their decision to waive enforcement of key patents. However, non-standardized codes may require special licensing arrangements.

Trademark Issues in South Korea:

In South Korea, Denso Wave's trademark application for 'QR Code' was refused due to the term being viewed as genericized among the South Korean public to refer to matrix barcodes in general. This indicates that the term has become widely used and understood beyond its specific trademarked meaning in that jurisdiction.

In summary, while QR code technology itself is freely licensed under certain conditions, the term 'QR Code' is a registered trademark of Denso Wave, with protections varying by jurisdiction. Users should be mindful of these trademark protections when using the term in commercial contexts, especially in regions where the trademark is actively enforced.
