Background on Data Matrix

U.S. Patent 5,612,524

U.S. Patent 5,612,524 (often referred to as the '524 patent) was granted on March 18, 1997. It covered a system for capturing and reading 2D symbology codes, which included Data Matrix codes. This patent was set to expire in November 2007.

Claims by Acacia Technologies

Before the '524 patent expired, Acacia Technologies, an intellectual property company, claimed that the use of Data Matrix was partially covered by the '524 patent. Acacia allegedly contacted various users of Data Matrix technology, demanding license fees for the use of the patented technology. This move by Acacia prompted significant concern among companies using Data Matrix, as they faced potential licensing costs and legal disputes.

Cognex Corporation's Legal Action

Cognex Corporation, a prominent manufacturer of 2D barcode reading devices, was one of the companies affected by Acacia's claims. Cognex responded by filing a declaratory judgment complaint on March 13, 2006, seeking a legal determination on the validity and enforceability of the '524 patent. Cognex aimed to protect its customers and itself from the licensing demands made by Acacia.

Court Ruling in Favor of Cognex

On May 19, 2008, Judge Joan N. Ericksen of the U.S. District Court in Minnesota ruled in favor of Cognex. The court held that the '524 patent was both invalid and unenforceable. The invalidity was based on several grounds, including inequitable conduct by the defendants during the procurement of the patent. This meant that the patent should not have been granted in the first place due to misleading or incomplete information provided to the patent office.

Although the court ruling came after the patent had already expired in November 2007, it had significant implications. It precluded any claims for infringement based on the use of Data Matrix technology before the expiration date. This ruling effectively protected companies from retrospective licensing demands and infringement claims by Acacia.

German Patent Application DE 4107020

Another relevant patent application in the context of Data Matrix technology was the German patent application DE 4107020, filed in 1991 and published in 1992. This German patent was not cited during the examination of the '524 patent in the United States.
